AB: 341 Mandatory State Recycling Requirements for Businesses and Multi-Family Communities

In July of 2012, the State of California enacted AB 341, a mandatory commercial recycling provision affecting businesses and multi-family communities.

WHO MUST RECYCLE
California State law requires the following businesses to have a recycling program in place:
  • Any business that generates 4 cubic yards or more of garbage per week; and
  • All multi-family communities with 5 or more units

HOW TO ARRANGE FOR RECYCLING SERVICES
Businesses and multi-family communities that meet the threshold are required to have a recycling program in place. If you do not have a recycling program in place, you may contact Turlock Scavenger to sign-up for recycling services at (209) 668-7274.

INFORMATION FOR APARTMENT OWNERS-MANAGERS
It is important that both apartment managers and tenants understand the requirements to recycle, which materials can be recycled and where to place them for collection.
  • State law requires multi-family communities with 5 or more units to recycle.
  • State law requires apartment owners to provide recycling services, and residents are required by law to recycle.
  • Materials are available to assist in educating tenants about proper procedures for recycling. See the links box on this page for links to educational materials and publications.
  • Consider placing information in areas such as laundry rooms or at garbage collection locations.
  • Consider providing information to new tenants when the lease is signed and annually to all other tenants.
  • Consider including recycling requirements in tenant leases.

*The City of Turlock has individual collection totes available for multi-family communities for free, provided upon request. To take advantage of this service, contact the Municipal Services Department at 209-668-5590 or email municipalservices@turlock.ca.us. This program is based on a first-come first-served basis as the City has limited inventory.

AB 1826 (2014) MANDATORY COMMERCIAL ORGANICS RECYCLING

California's Mandatory Commercial Organics Recycling Law, AB 1826, requires certain businesses to arrange for organic waste recycling services.

WHO MUST RECYCLE?
California State law requires the following businesses to have an organics recycling program in place:
  • Commercial businesses and multifamily dwellings of 5 or more units that generate two cubic yards or more of commercial solid waste (garbage + recycling + organics) per week are required to recycle all of their organic waste.
On or after January 1, 2020, if CalRecycle determines that the statewide disposal of organic waste has not been reduced to 50 percent of the level of disposal during 2014, the organic recycling requirements on businesses will expand to cover businesses that generate 2 cubic yards or more of commercial solid waste per week. Additionally, certain exemptions (listed below) may no longer be available if this target is not met.

WHAT IS ORGANIC WASTE?
Organic waste as defined in the law includes the following material: food waste, green waste, landscape and pruning waste, nonhazardous wood waste, and certain food-soiled paper waste that is mixed in with food waste.

SELF-HAUL
Your business or multi-family community may already have a landscaping service which collects your yard waste and delivers it to a local facility for recycling. If yard waste is the only type of organic waste generated on your property, and you have a third-party service or are taking organics to a local facility for recycling yourself, please fill out and submit the self-haul portion of the AB 1826 Exemption and Self-Haul/Backhaul form to the City to document your compliance with State law

EXEMPTIONS
The State allows exemptions to be approved by the City of Turlock on a case-by-case basis. If you believe your business or multi-family community meets one on the AB 1826 Exemption and Self-Haul/Backhaul form, please fill out and submit the form to the City to document your compliance with State law.
  • Lack of sufficient space to provide additional organic material recycling containers.
  • The current implementation of actions (such as food donation) that result in the recycling of a significant portion of organic waste.
  • Limited-term exemptions for extraordinary and unforeseen events.
  • The business or group of businesses subscribes to 2 or more cubic yards of solid waste per week and generates less than 20 gallons of organic waste.
  • The business or group of businesses subscribes to less than 2 cubic yards of solid waste per week and generates less than 10 gallons of organic waste.
AB 1826 Exemption and Self-Haul/Backhaul

AB 827 (2019)

Effective July 1, 2020, Mandatory Commercial Recycling and Organics Recycling (MCR and MORe) requires businesses, public entities, and schools to provide recycling and organics containers at front-of-house to collect waste generated by customers from products they purchase and consume on the premises. These containers must be placed adjacent to trash containers.
